Terms of Service

1. Acceptance of Terms

By accessing or using OfferPilled (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Service

OfferPilled is a service that provides personalized job recommendations delivered to your inbox. The Service currently offers a free tier and may introduce paid plans or premium features in the future. The Service uses artificial intelligence to generate fit rationale, risk analysis, gap assessment, and cover letter drafts for each recommendation. The Service relies on third-party AI providers and third-party search providers to process your data and identify job listings.

If we introduce paid features, pricing and billing terms will be communicated to you in advance. You will not be charged without your explicit consent. Any paid subscriptions will be subject to additional terms presented at the time of purchase.

The Service is provided on an “as available” basis. We do not guarantee uninterrupted or error-free operation and may perform maintenance, updates, or modifications at any time without prior notice.

3. Account Registration

To use the Service, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

  • You must provide accurate and complete information during registration.
  • You must be at least 16 years old to create an account.
  • You are responsible for keeping your password secure.
  • You must notify us immediately if you suspect unauthorized access to your account.
  • You may not create multiple accounts or share your account with others.

4. User Responsibilities

You agree to use the Service in good faith and provide truthful information in your profile. The quality of your recommendations depends on the accuracy of the profile data you provide. You acknowledge that inaccurate or misleading profile data may result in unsuitable recommendations, and OfferPilled bears no responsibility for the consequences of inaccurate user-provided information.

5. Acceptable Use

You may not use the Service to:

  • Violate any applicable laws or regulations.
  • Impersonate another person or misrepresent your affiliation.
  • Attempt to gain unauthorized access to the Service or its systems.
  • Scrape, crawl, or otherwise automatically collect data from the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to generate content for purposes that are fraudulent, deceptive, or harmful.
  • Resell, redistribute, or commercially exploit any output of the Service without prior written consent.
  • Abuse the referral program through fraudulent or misleading activity.

6. License to User Content

You retain full ownership of the data you provide to the Service, including your profile information, resume content, and preferences (“User Content”). By submitting User Content to the Service, you grant OfferPilled a non-exclusive, worldwide, royalty-free license to use, process, transmit, and store your User Content solely for the purpose of operating and providing the Service to you. This includes transmitting your data to third-party AI providers to generate job recommendations, fit assessments, and cover letter drafts on your behalf.

This license terminates when you delete your account, at which point we will remove your User Content in accordance with our Privacy Policy.

7. Intellectual Property

The Service, including its design, software, algorithms, features, branding, and all content generated by the Service (excluding User Content), is the property of OfferPilled and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

AI-generated outputs (including cover letters, fit rationale, risk analyses, and gap assessments) are provided to you for your personal use in connection with your job search. You may use these outputs freely for that purpose, but you acknowledge that similar outputs may be generated for other users.

8. Third-Party Services and Content

The Service surfaces job listings from external sources and relies on third-party providers for AI processing, web search, and email delivery. OfferPilled does not control, endorse, or guarantee the accuracy, availability, legitimacy, or completeness of any third-party job listing, employer information, or content.

You acknowledge that:

  • Job listings may be outdated, inaccurate, or no longer available by the time you view them.
  • OfferPilled is not responsible for the hiring practices, legitimacy, or conduct of any employer whose listings appear in your recommendations.
  • Third-party service providers are subject to their own terms of service and privacy policies.
  • Service availability may be affected by third-party provider outages beyond our control.

9. Disclaimers and Warranty

9.1 Service Provided “As Is”

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, OFFERPILLED DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

9.2 AI-Generated Content

All content generated by the Service — including job recommendations, fit rationale, risk analyses, gap assessments, and cover letter drafts — is produced by artificial intelligence and may contain inaccuracies, errors, or outdated information. AI-generated content does not constitute professional career advice, legal advice, or any form of professional guidance. You are solely responsible for reviewing, verifying, and customizing any AI-generated content before use.

9.3 No Employment Guarantees

OfferPilled does not guarantee that you will receive employment offers, interviews, or any particular outcome as a result of using the Service. Job recommendations are informational in nature and do not constitute endorsements of specific employers or positions.

9.4 Service Availability

We do not warrant that the Service will be available at all times or that it will be free from errors, viruses, or interruptions. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without liability.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OFFERPILLED, ITS OWNERS, OPERATORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF OFFERPILLED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OFFERPILLED’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100.00) OR (B) THE TOTAL AMOUNT YOU HAVE PAID TO OFFERPILLED IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless OfferPilled, its owners, operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you submit through the Service; or (e) your use of AI-generated content provided by the Service, including any cover letters, assessments, or recommendations.

12. Termination

You may terminate your account at any time by deleting it through your account settings. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our Privacy Policy.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including if we reasonably believe you have violated these Terms. We are not liable to you for any suspension or termination of your access.

Sections 6 (License to User Content, with respect to data already processed), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), 13 (Dispute Resolution), 14 (Governing Law), and 18 (General Provisions) shall survive termination of these Terms.

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal legal action, you agree to attempt to resolve any dispute with OfferPilled informally by contacting us through our feedback page. We will attempt to resolve the dispute informally within thirty (30) days. If the dispute is not resolved informally, either party may proceed with formal resolution as described below.

13.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association (“AAA”). The arbitration shall be conducted in English. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

13.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST OFFERPILLED.

13.4 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court’s jurisdictional limits.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

15. Electronic Communications

By creating an account, you consent to receive electronic communications from OfferPilled, including job recommendation emails (daily or weekly based on your preferences), transactional emails (account verification, password resets), and service announcements. You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

You may manage your email preferences or unsubscribe from recommendation emails at any time through your email settings or by clicking the unsubscribe link included in every email.

16. Referral Program

OfferPilled may offer a referral program that allows you to share a unique referral link. The referral program is subject to the following conditions:

  • Referral links are for personal, non-commercial sharing only.
  • You may not use paid advertising, spam, or deceptive tactics to distribute referral links.
  • OfferPilled reserves the right to void referral credits and suspend accounts engaged in fraudulent or abusive referral activity.
  • OfferPilled may modify or discontinue the referral program at any time without notice.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least fourteen (14) days before the changes take effect. Continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

18. General Provisions

18.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and OfferPilled regarding the Service and supersede all prior agreements, understandings, and representations.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.

18.3 Waiver

The failure of OfferPilled to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by OfferPilled.

18.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. OfferPilled may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

18.5 Force Majeure

OfferPilled shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, labor disputes, government actions, power or internet failures, or third-party service provider outages.

18.6 Account Inactivity

We reserve the right to suspend or delete accounts that have been inactive for an extended period (twelve months or more) after providing reasonable notice to the email address associated with the account.
